TERMS OF SERVICE — TOXIC KITTY

1. Introduction

1.1 These Terms of Service (“Terms”) govern your use of the Toxic Kitty mobile application and related websites (the “Service”).

1.2 By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1.3 Toxic Kitty provides AI-powered toxicity assessments for informational purposes only. The Service does not provide veterinary or medical advice.

2. Eligibility

2.1 You must be at least 16 years old to use the Service.

2.2 By using the Service, you confirm you have the legal capacity to enter into these Terms.

3. Important Health Disclaimer

3.1 Toxic Kitty does not diagnose, treat or prevent illness.

3.2 AI-generated reports may contain errors, incomplete data or outdated information.

3.3 You must not rely solely on the Service when your cat’s health may be at risk.

3.4 If your cat appears unwell, distressed or may have ingested something harmful, you must contact a qualified veterinarian immediately.

3.5 All decisions made using the Service are your sole responsibility.

4. Account Registration and Security

4.1 You must create an account to use the Service. You agree to provide accurate, complete information.

4.2 You are responsible for maintaining confidentiality of your login details.

4.3 You must notify us immediately of unauthorised access.

4.4 We may suspend or terminate your account if we reasonably believe you have breached these Terms.

5. Licence to Use the Service

5.1 We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial purposes.

5.2 You may not:

(a) copy, reproduce or distribute the Service;
(b) reverse engineer, decompile or attempt to extract source code;
(c) commercially exploit the Service without written permission;
(d) circumvent or disable security measures;
(e) use the Service for industrial or laboratory toxicity testing.

6. Intellectual Property

6.1 Toxic Kitty owns all intellectual property rights in the Service, including: software, AI models, toxicity database, branding, design, content, graphics and code.

6.2 You may not use our intellectual property except as expressly permitted.

7. User Content

7.1 “User Content” includes images, notes, cat information and any other data you upload. You retain ownership of your User Content.

7.2 By uploading User Content, you grant Toxic Kitty a worldwide, royalty-free licence to:

(a) process and display your content to operate the Service;
(b) use anonymised derivatives to improve AI and enhance our toxicity database;
(c) store and manage your content securely.

7.3 You warrant that you own or have permission to submit the User Content and that it does not infringe third-party rights.

7.4 You must not upload content that is illegal, harmful, abusive, infringing, defamatory or otherwise objectionable.

7.5 We may remove content or suspend your account where appropriate.

8. Acceptable Use and Restrictions

8.1 You agree not to:

(a) use automated scripts, bots or scraping tools;
(b) interfere with or disrupt the Service;
(c) upload viruses or harmful code;
(d) conduct mass or automated toxicity scanning;
(e) attempt to gain unauthorised access to our systems;
(f) use the Service for unlawful or harmful purposes.

8.2 We may monitor usage to detect misuse and protect system stability.

9. Subscriptions and Payments

9.1 Certain features may require a subscription.

9.2 Subscriptions are processed by the Apple App Store and RevenueCat.

9.3 All billing, renewals and refunds follow App Store policies.

9.4 Deleting the app does not cancel your subscription; you must do so via your App Store account.

10. Fair Use & “Unlimited” Scans

10.1 “Unlimited” scanning is subject to fair use.

10.2 We may apply rate limits or restrictions where usage is excessive, automated or harmful.

10.3 Normal consumer use is not affected.

11. Third-Party Services

11.1 The Service integrates with third-party providers such as Firebase, Google Vision, OpenAI, Gemini and RevenueCat.

11.2 We are not responsible for the content, policies or practices of third-party services.

12. Disclaimers

12.1 The Service is provided “as is” and “as available” without any warranties.

12.2 We do not warrant that the Service will be accurate, reliable, uninterrupted or error-free.

12.3 To the fullest extent permitted by law, all implied warranties are excluded.

13. Limitation of Liability

13.1 To the fullest extent permitted by law, Toxic Kitty shall not be liable for any:

(a) indirect, incidental or consequential damages;
(b) loss of profits, data, goodwill or business;
(c) damages arising from reliance on AI-generated outputs.

13.2 Our total liability to you for any claim shall not exceed:

(a) the amount paid by you in the preceding 12 months; or
(b) £100, whichever is greater.

13.3 Nothing excludes liability for:

(a) fraud;
(b) death or personal injury caused by negligence;
(c) any liability that cannot be excluded by law.

14. Indemnification

14.1 You agree to indemnify and hold harmless Toxic Kitty and its officers, employees and contractors against any claims, losses, damages or costs arising from:

(a) your misuse of the Service;
(b) your breach of these Terms;
(c) your infringement of third-party rights.

15. Termination

15.1 We may suspend or terminate your account at any time where:

(a) we reasonably believe you have breached these Terms;
(b) your behaviour poses a security or operational risk;
(c) you engage in unlawful or harmful conduct.

15.2 Upon termination:

(a) your licence to use the Service ends immediately;
(b) your access to the Service is revoked.

16. Changes to the Service or Terms

16.1 We may modify, update or discontinue the Service at any time.

16.2 We may amend these Terms periodically.

16.3 Continued use of the Service constitutes acceptance of updated Terms.

17. Governing Law

17.1 These Terms are governed by the laws of England and Wales.

17.2 The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections.

18. Apple App Store Terms

18.1 Where the app is downloaded via the Apple App Store, you acknowledge that:

(a) these Terms are between you and Toxic Kitty, not Apple;
(b) your license to use the app is limited to a non-transferable license to use the app on an Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing;
(c) Apple has no responsibility for the app or its content;
(d) Apple is not obligated to provide support;
(e) in case of a warranty failure, Apple may refund the purchase price;
(f) Apple is not responsible for legal claims relating to the app;
(g) Apple and its subsidiaries are third-party beneficiaries of these Terms.

19. Miscellaneous

19.1 Entire Agreement – These Terms and the Privacy Policy constitute the entire agreement between you and Toxic Kitty.

19.2 Severability – If any clause is found invalid, the remainder shall remain effective.

19.3 Waiver – Failure to enforce a right does not constitute a waiver.

19.4 Assignment – You may not assign any rights; Toxic Kitty may assign these Terms.

19.5 Force Majeure – We are not liable for delays caused by events beyond our reasonable control.
